Terms of Service

1. ACCEPTANCE OF TERMS

Welcome to Clark Screen Printing Online Services. Clark Screen Printing (hereafter CSP) provides its service to you, subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS at any time at: http://www.clarkscreenprinting.com/terms.php. In addition, when using the Online Quote (Quick Quote) services, you shall be subject to any posted guidelines, disclaimers or rules applicable to such services which may be posted from time to time without notice. All such guidelines, disclaimers or rules (including but not limited to our Online Quote services) are hereby incorporated by reference into the TOS.

2. DESCRIPTION OF ONLINE SERVICE.

CSP provides screen printing and embroidery to those that visit their establishment in Murray, Utah and purchase services in person there (the “Local Service”). CSP also provides screen printing and embroidery to those that access those services, not in person at the establishment in Murray, Utah, but instead on the internet where they purchase services from anywhere in the world using our online order form (the “Online Service”). You understand that our Local Service has a different TOS than our Online Service. Unless explicitly stated otherwise, any new features that augment or enhance the current Online Service shall be subject to the TOS. You understand that a Preliminary Order is any service provided at the “Order Desk” when you use our Online Service. When you place a Preliminary Order, you understand that you will receive an invoice and art sample reflecting the order you placed within two business days. When you receive your art sample and invoice, you understand that sending your credit card number and personal information from our Secure Ordering page constitutes your express permission for CSP to print or embroider the goods specified on your Preliminary Order and charge the amount specified on the invoice which CSP sends for approval. You understand that CSP offers free shipping for all orders that are placed using the Online Service with the following stipulations: First, to receive free shipping, you must use UPS ground shipping. Second, to receive free shipping, the packages must be sent somewhere in the United States, excluding Hawaii and Alaska. CSP accepts no responsiblity to provide free shipping outside of the lower 48 states. CSP reserves the right to charge for shipping when any type of shipping other than UPS ground is requested using the Online Service. You understand that free shipping is not available through the Local Service. You must use the Online Service to receive free shipping. You understand that the colors which appear in small boxes on Step 5 of our Online Quote (Quick Quote) are intended to be representative of but NOT identical to the color of the actual item you order. You further understand that any photo of a product offered by CSP may not be the identical color of the product you order. CSP reserves the right to not fulfill its obligations of timliness should the required data in preliminary orders not be complete, or if technical difficulties (such as but not limited to e-mail defects,glitches or problems) be present at the time of ordering.
You understand that any price that is shown on the Online Quote (Quick Quote) represents only an estimate of the actual price of the items being quoted. CSP reserves the right to change its prices with or without notice at any time. CSP reserves the right to charge any price for any item, regardless of what Online Quote (Quick Quote) has been issued to you in the past.

3. “BUSINESS DAYS”

You understand that CSP does not provide either Local Service or Online Service on non-business days. You understand “business days” to signify any days that are not Saturday, Sunday, a national holiday of the United States of America, a Utah state holiday, the day after Thanksgiving or any day between December 23 and January 2.

4. OBLIGATIONS

In consideration of your use of the Online Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Preliminary Order (such information being the "First tell us about your order" data) and (b) maintain and promptly update the Preliminary Order form data to keep it true, accurate, current and complete each time you place a preliminary order. If you provide any information that is untrue, inaccurate, not current or incomplete, or CSP has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, CSP has the right to suspend or terminate your account and refuse any and all current or future use of both the Online Service and the Local Service (or any portion thereof).

5. CSP PRIVACY POLICY

6. GENERAL INFORMATION

The TOS constitute the entire agreement between you and CSP and govern your use of the Online Service, superceding any prior agreements between you and CSP. The TOS and the relationship between you and CSP shall be governed by the laws of the State of Utah without regard to its conflict of law provisions. You and CSP agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Salt Lake, Utah. The failure of CSP to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provisions, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TOS are for convenience only and have no legal or contractual effect.

7. VIOLATIONS
